This page explains Listcrawler LLC's position with respect to the record-keeping and labeling requirements of 18 U.S.C. § 2257 and 2257A (the "Act"). It is intended to clarify our role as an aggregator, describe the safeguards we have in place, and tell you how to get in touch if you believe any content on Listcrawler may involve a minor or otherwise violate the Act.
What 18 U.S.C. § 2257 Requires
18 U.S.C. § 2257 and 2257A are federal laws that require producers of certain types of sexually explicit visual depictions to (a) verify that every performer is at least 18 years old at the time of depiction using a reliable form of photo identification, (b) maintain records documenting that verification, and (c) include a statement on or in connection with the content indicating where those records are kept.
The statute defines "producer" narrowly. A secondary producer is generally a person or entity who creates, alters, or directly inserts the depictions into their own material. The statute contains a well-known exemption for activities that are "not the production" of depictions, including passive indexing and linking.
Our Role as an Aggregator
Listcrawler is not a producer of any content within the meaning of 18 U.S.C. § 2257. Specifically:
- We do not create, generate, direct, stage, or commission any of the visual depictions displayed on the Service.
- We do not host, store, or serve any of the primary content (photos, videos, etc.) — we display thumbnails and metadata from publicly available third-party sources and link out to the original locations.
- We do not edit, modify, or alter the substantive content of any listing.
- We do not pay, employ, or contract with any of the individuals depicted on the Service.
Because our activities are limited to indexing and linking, we fall within the exemption described in 18 U.S.C. § 2257(h)(2)(B)(v) and are not subject to the record-keeping requirements of the Act.
The original producers of any content displayed on the Service are the parties responsible for complying with 18 U.S.C. § 2257. Their records are maintained at the location designated by the source site where the content originates.
Our Age-Verification Commitment
Even though Listcrawler is not itself subject to 18 U.S.C. § 2257, we take the issue of age extremely seriously. We maintain a zero-tolerance policy toward any listing that involves, or appears to involve, a person under the age of 18.
To uphold that policy:
- We require all users to be 18 or older to access the Service (see our Terms of Service).
- We remove any listing that is reported or flagged as potentially involving a minor, immediately and without requiring confirmation.
- We report any suspected child sexual abuse material (CSAM) to the National Center for Missing & Exploited Children (NCMEC) CyberTipline and cooperate fully with law enforcement.
- We preserve relevant information for investigators when lawfully requested.
Custodian of Records (Nominal)
Although we do not produce content subject to 18 U.S.C. § 2257, we designate the following point of contact for any legal correspondence relating to this statement. This is not a statement that Listcrawler maintains § 2257 records — those records, if any, are maintained by the original producers of the content at their respective locations.
